    Careless Driving Traffic Tickets

Careless Driving Tickets - What the law says

     Everyone commits the offence of careless driving who drives a vehicle or streetcar on a highway without due care and attention, or without reasonable consideration for other persons using the highway, and on conviction for Careless Driving the driver is liable to a fine not less than four hundred ($400) dollars, and not more than two thousand ($2000) dollars, or to imprisonment for a term of not more than six months, or to both, and in addition his or her drivers licence may be suspended for a period of not more than two years.

Careless Driving Example 2:

Subsequently the insurance company canceled the driver’s insurance due only to the Careless Driving conviction on their driving record.

Careless Driving Example 3: 0 R3 |' Q( g0 d' u
The driver was involved in a serious fatal crash. The driver survived the accident but was taken to the trauma unit at the hospital by emergency ambulance. The police attend at the scene then when to the hospital to speak to the surviving driver.

% a% G" q( P* w: B3 s# F" a1 F9 oThe driver tried to cooperate with the police, but due to his injuries from the severe impact was unable to remember or recall what happened. The police called in a technical accident reconstructionist, who investigated the accident and deemed the injured driver at fault in the accident.   R& X3 c' c4 v& HThe driver came to 1-888-9958-995, explaining that he was very upset over the incident, and wished a independent review, so he could find out what happened, and looking representation for the charge.

The fine for a Red Light traffic ticket or Amber light traffic ticket is not the only penalty for the ticket. A red light or amber light traffic ticket has four different penalties:

Determination of fault in accident cases

Red Light Traffic Ticket - Highway Traffic Act 144,18
: {" K- R" Q' q! f2 M* |, }The Highway Traffic Act of Ontario states:

"Every driver approaching a traffic control signal showing a circular red indication, or red light and facing the indication shall stop his or her vehicle and shall not proceed until a green indication is shown."  Ontario Highway Traffic Act Section 144.18

Red Light Traffic Tickets - Insurance implications

$ v- v2 o$ q3 ]/ N' C! ?$ EAs well as the demerit points implications, any insurance company will consider a red light traffic ticket as a serious offence.  Insurance companies perceive that a conviction for disobeying a red traffic signal means:

"the driver is driving through intersections on a red traffic signals, the driver does not follow the rules of the road, and the likelihood of the driver being involved in an accident is higher".

A conviction for a Red light/Amber light violation stays on a driving record for three years from the date of the offence and can dramatically affect insurance rates. If there is an accident involved the period can be up to six (6) years.
! r. ?8 d+ {# r* h* A6 x; T! k" s% g0 ?. ^' W" V0 X) ~
Insurance companies base an insurance policy on "their risk" of having to pay out on a claim. If you pay the traffic ticket, plead guilty or are convicted of a red light traffic ticket, this can affect your insurance rates for years.
Fighting a Red Light Ticket

Red Light Traffic Tickets, as the wording for Disobeying a Red Light suggests, the driver of a vehicle must stop their vehicle before proceeding through a red traffic light.

Although the traffic ticket sounds simple there are many issues for a red light ticket in court, for example;

where exactly was the driver required to stop? in the intersection, before the intersection, before the crosswalk, or before the stop line?

were the traffic lights working properly?

did the officer have a clear view of the intersection?

To fight a red light ticket your need to know the essential elements that the prosecution has to prove against the driver, and how to run a court trial, you risk being convicted of the ticket.

A red light traffic ticket is considered a serious traffic offence. In most cases the court will not listen to any explanation why the driver went through the red light, only did the driver go through the light and can the prosecutor and police officer prove the charge to the judge. + w* k3 j* y& C6 m

Any explanation the driver gives is not something that will get the charge dropped, an explanation is not a defense a traffic ticket. All the judge is allowed to do with an explaination is reduce the fine, but the conviction and demerit points will still be applied.

Going to Trial

At trial the police officer will have a government appointed prosecutor or lawyer to assist them as counsel.

Fighting a Disobey Red light ticket requires trial knowledge and technical experience regarding time and distance. For example,

If a vehicle is traveling at a speed of 50km/h, then a vehicle is traveling at 44 feet every second. - e: u, `& U% b

If the officer at trial says the vehicle was one car length behind the line when the light turned red, what the officer is really saying is that for .06 of a second or less the driver violated the traffic lights.

When a trial can involve technicalities of as little as .06 of a second you know it’s important to have an expert on your side.

Red Light Traffic Ticket - Red light Camera Ticket

9 t* z2 J/ y& rRed light camera tickets are traffic tickets issued as a result of a traffic camera being placed at an intersection to photograph vehicles who enter the intersection after the traffic signal has turned red.8 f/ \" {% a1 O; g& Q3 B+ D# k
Upon being photographed traveling through the intersection on a red traffic signal, the municipality will issue a notice to the owner of the vehicle.7 G  y$ b3 X2 N: _
The violation notice will have a picture of the vehicle showing the speed it was traveling, and that the traffic signal was red when the vehicle entered.6 R& J9 ]; ~$ ]0 W8 Q
The penalty for a Red light Camera Ticket:
  • a fine of three hundred and twenty five dollars ($325.00)
  • there is no loss of demerit points
  • the insurance company is not notified about the traffic ticket
  • there is no record kept of the traffic ticket on the drivers licence
  • the traffic ticket goes against the vehicle not the driver.
Disobey Amber Light Traffic Tickets
- r* T2 C2 `+ }' p2 l. I& K5 H The Highway Traffic Act of Ontario section 144.15 states:

"Every driver approaching a traffic control signal showing a circular amber light and facing the light shall stop his or her vehicle if he or she can do so safely, otherwise he or she may proceed with caution."

The penalties for disobeying a amber traffic light are the same as if you went through a red traffic light.
  • Three demerit points
  • A fine of one hundred and eighty dollars ($180.00)
  • A conviction registered on your driving record for three years
  • Insurance increases

, I/ p4 P9 Q) o6 C; bThere are different issues to take into consideration for an amber light traffic ticket. At traffic court the defendant (driver) has to prove to the court that they "did not believe that they could stop safely before reaching the intersection, so they proceeded through the intersection with caution".

Like any traffic ticket the Police and Prosecutor have to prove a stop sign ticket "beyond a reasonable doubt" to the Judge. Beyond a reasonable doubt means that the Justice of the Peace must be one hundred percent certain the driver committed the offence. "No doubt in their mind".; c2 D# |% v1 p8 D5 r
The police are required to prove all the essential elements of the charge described in section 136 of the Ontario Highway Traffic Act. 4 Y! B# O1 @7 c) p7 Q' Y; Z& ?7 ]' D! n8 {
At trial the police officer will have a government appointed court prosecutor to assist them as counsel. It's equally important that you are well represented, or you risk being convicted and receiving the four penalties for a stop sign ticket.
6 `# x& x' R4 [7 K  f6 K- ~. [( ]6 vThe prosecutor is a trained professional who represents the municipality. Most Prosecutors are extremely fair individuals, however the prosecutor is not there to help you get your ticket dropped. It is the prosecutors job to convict you of the ticket.

For most stop signs tickets in Ontario the court prosecutor will want to have a trial. The Highway Traffic Act of Ontario says, Every driver or street car operator approaching a stop sign at an intersection,
  • shall stop his or her vehicle or street car at a marked stop line or, if none, then immediately before entering the nearest crosswalk;
  • or if none then immediately before entering the intersection;
  • and shall yield the right of way to traffic in the intersection or approaching the intersection on another highway so closely, that to proceed would constitute an immediate hazard and,
  • having so yielded the right way, the driver may proceed.

/ k3 w% z  N% M( ^! B5 VAt traffic court, stop sign tickets in many jurisdictions are trial only matters, meaning that the prosecutor will not drop the charge or take your explanation into consideration, and the ticket will go to trial before a judge.

  • three (3) demerit points
  • $110 dollar fine
  • Conviction goes on your insurance for 3 years

Just because an “international sign” indicates something, does not mean that the sign is in fact enforceable. A prohibited turn traffic ticket has the following penalties:

A disobey sign ticket from the police means that a sign has been lawfully placed on the roadway indicating that a turning movement is prohibited, e.g. no turn between 7am and 9am.
